This page also provides you with valuable links to other resources.April 17th - Huge Victory in NLRB Poster CasePlease be advised that the NLRB’s “Notification of Employee Rights” notice posting rule compliance date of April 30 is no longer in effect due to an injunction ordered by the U.S. Court of Appeals for the D.C. Circuit. The injunction comes in response to a request filed last month by the ABC-led Coalition for a Democratic Workplace (CDW). 

In addition, last Friday afternoon, a federal District Court judge in South Carolina (5th Circuit) ruled that the NLRB notice posting requirement was unlawful, citing the Board’s lack of statutory authority.The injunction places the rule on hold indefinitely while the appeals court considers CDW’s appeal of the U.S. District Court’s unfavorable ruling. As previously stated, the rule’s previous compliance date of April 30, 2012 is no longer in effect.  As a practical matter, this means the poster will not go into effect until after the November election, if at all. We will keep you informed of any new developments regarding the legal challenges or the rule’s effective date. In the meantime, if you have specific questions about the legal challenge, please contact me. Bottom line: No ABC member should post the NLRB notice until further notice.In addition, please visit ABC's NLRB Notice Posting Rule page for the most up-to date information and resources on compliance with the rule, should it eventually go into effect.ABC and CDW will continue to pursue the appeal with the goal of achieving a fair, full, and correct legal remedy.
